This thought-provoking program will challenge participants to examine the pressures facing judges, prosecutors, defenders, and police – those who are charged with the duty not only to uphold the justice system but also to protect individual liberty. Participants will hopefully come away with a renewed commitment to ensuring that the rule of law in not used as a tool of oppression.


3:00 – 4:30 PM Law, Justice, and the Holocaust: How the Courts Failed Germany
Participants will critically examine the pressures faced by German jurists under the Nazis. Using legal decrees, judicial opinions, and case law of the period, Dr. Meinecke and Ms. O’Rourke will study the role of judges in the destruction of democracy and the establishment of the Nazi German state. This close scrutiny of the past proves a framework for a debate on the role of the judiciary in the United States today:

• What is the responsibility of judges to the legal system as a whole?
• What have been the challenges to a fair and impartial administration of justice in the United States?
• What can judges do to ensure that the kinds of failures that led to the Holocaust do not happen in this country?
• How have judicial and legal professional codes of conduct changed after the Holocaust?
• What pressures and motivations may have affected members of the legal profession as the Nazi government consolidated its power in the 1930s?
• Besides members of the judiciary, what other professionals were charged with crimes in the wake of the Holocaust?
